Philosophy spans the reaches of the human mind in countless topics, but is often divided into three main branches: metaphysics, the study of the nature of existence; epistemology, the study of knowledge and truth; and ethics, the study of morals. One of the first philosophers to look at these fields is Plato (427BCE-347BCE), whose writings are incredibly influential. Plato’s work lays the fundament for philosophy because of his cohesive contributions to the fields of metaphysics, epistemology, and ethics.Firstly, Plato’s work with Forms greatly influences metaphysics. He contributes the idea of the Forms which exist as â€Å"eternal and perfect ideals that exist in an unchanging, perfect heaven† (via Velasquez, 2002, p. 84). [2] The Forms contrast with worldly matter; this contrast leads to Plato’s next contribution to metaphysics, his concept of â€Å"Two Worlds. † Plato divides reality into the worlds of senses and forms, the latter of which he co nsiders to be true reality and where the soul resides.Finally, Plato’s description of the tripartite human soul greatly influences St. Augustine’s religious work on Christianity 800 years later. Therefore, Plato’s Forms helped shape metaphysics. Secondly, Plato’s Forms and myths built the foundation for epistemology. Plato argues that due to the soul's unchanging nature, the process of â€Å"learning† is the soul’s recollection of knowledge. He also provides two myths, both closely related to his metaphysical works.In the first, the Chariot Allegory, Plato describes a charioteer en route to heaven, in which there exists â€Å"true reality [the forms] with which real knowledge is concerned † (as cited by Velasquez, p. 84). The journey is impeded by an unruly horse that represents ignobility. The concept of the journey’s difficulty is mirrored, finally, in the Allegory of the Cave, which discusses ignorance and the escape thereof . Thus, Plato’s myths form the basis of epistemology. Finally, Plato’s work in ethics regarding justice is among the first and most influential.Firstly, he defines justice as the balance between the three parts of the tripartite soul. Thus, his justice theory states that justice in both the state and the individual is defined by â€Å"harmony between the various parts for the good of the whole† (Velasquez, 2002, p. 630). This justice theory shows cohesiveness with Plato’s tripartite theory of the soul. Finally, Plato associates justice with merit: individuals are treated proportionally to their talents and accomplishments. Hence, Plato's philosophies regarding justice form the starting point for the field of ethics.In conclusion, Plato’s writings act as a basis and connection for the three main branches of philosophy: metaphysics, through his Forms; epistemology, through his myths; and ethics, through his justice theory. His influence on philosophy and society is expansive and, as such, Plato is one of the most significant philosophers. Andrea Yates had battled with postpartum depression for years and on June 20, 2001, she drowned all five children in the bathtub of her home. Ultimately the underlining cause of her actions was caused by postpartum psychosis that was triggered by Andrea’s improper use of her medication, failure to adhere to her doctor’s advice after treatment, and her lack of knowledge of coping techniques commonly used by women who suffer from postpartum depression. Postpartum depression can take up to a year after the birth of a child before the mother would even notice the signs of depression and in Yates’s case if left untreated can have a tragic affect on the person and everyone around him or her. A psychopath is someone is has a mental disorder or display violent behaviors. There is nothing that scares them, there are four subtypes of psychopaths. A word that means the same to the normal person does not mean the same to him or her, they think very different from the way that normal people do, which is referred to as â€Å"semantic aphasia.† The Secondary Psychopaths, these types of psychopaths are not afraid to take risks of any kind, stress reactive, worry a lot, guilt-prone. These types of psychopaths worry more than the average person. A Secondary Psychopaths, are adventurous, and play by their own rules, they try to avoid pain and cannot resist temptation. Distempered Psychopaths are those that go into a rage very quickly. This type does not usually happen with women, it is more of the men who it mainly happens to. The men who are distempered psychopaths have a high sex drive and get a high off excitement. Charismatic Psychopaths are very charming and gifted this is how they become very good manipulators, fast talkers can persuade others out of anything. A psychopath has always existed, for many, many years. They have existed in many forms and fashion so most people would never know who is a psychopath, until he or she has  encountered one. When Andrea father passed away, she became even more depressed, she stopped doing the things that should would do normally to take care of herself as well as her kids. After the birth of her first child, Yates began to have hallucinations about committing violent acts, by the birth of her fourth child Yates mental condition had gotten worse that her doctor was against the idea of Yates conceiving another child with the severity of her mental condition, and that yates was at high risk for developing postpartum psychosis. â€Å"After the birth of her fifth child and the death of her father,  she went into a severe depression and was forcefully admitted to Devereux-Texas Treatment Network.† (Andrea Yates Biography, 2012, para. 3) Although Yates was seen by a psychiatrist diagnosed and treated for her depression because of the limitations health care places on the amount of days a person could stay in the hospital and remain covered Yates was often released before she could learn how to cope with her postpartum depression. Yates attending psychiatrist would prescribe her antidepressants and antipsychotic medication but Yates would often not take her medication, as her taking the medication would make it difficult for Yates to conceive or nurse her child. After Yates condition worsens, her doctor suggests supervision of Yates around the children and without proper treatment for her mental illness and depression. Yates’s doctor advised against the ideal of Yates left unsupervised with her five children and even though Yates was left alone for one hour, and as a result she took that hour and drowned all five children in the bath tub in her home. After her fifth child was born she was hospitalized again from March 31, 2001 through April 10, 2001, and from May 4, 2001 through May 14, 2001 (Resnick, 2012). The last time she was admitted to the psychiatric hospital was on June 20, 2001, just three weeks before she drowned her five children. Andrea Yates told her husband and her doctors that she was hearing voices and that certain programs on television were telling her that she was a bad mother and was raising her children in a sinful way. Doctors diagnosed Andrea Yates with Postpartum psychosis and depression. Andrea tried on two separate occasions to commit suicide; once trying to overdose on pills and by putting a knife to her throat (McLellan, 2006). Although she was being evaluated by her psychiatrist she was prescribed medication called Haldol, which helped her bounce back from her delusional thoughts and depression. Psychopaths can develop different behavioral traits depending on certain events in their lives. Some of the  most common traits are post-partum psychosis, delusions, schizophrenia, depression, and a belief that they are possessed. These traits can develop from the loss of a loved one, childbirth, stress, and low self-esteem to name a few. Most of the time medication is provided to help with those behavioral traits, while other times hospitalization is required. Most psychopaths experience some sort of violent behavior whether it is inflicted on a loved one, a stranger, or even themselves. Many times psychopaths do not voice their problems with others and symptoms can go undetected if someone is not aware of what to look out for. Conclusion Andrea Yates was an individual who was unaware of her genetic history that even when warned about of the effects of Yates if she were to continue having children with her mental condition. Despite the warning signs of Yates attempted suicide, delusions, and catatonic states was a clear sign that Yates was in desperate need of help. This tragedy occurred because many people do not want to admit that he or she have a problem or even admit the he or she needs help until it is too late. Guido Fubini Essay Guido Fubini, A famous mathematician, was born January 19th 1987 in Venice, Italy. His father, Lazzaro Fubini, was a mathematics teacher so he came from a mathematical background. Guido was influenced by his father towards mathematics when he was young. He attended secondary school in Venice where he showed that he was brilliant in mathematics. It was then clear that from this stage he would follow this career. In 1896 Guido entered the Scuola Normale Superiore di Pisa. There he was taught by Dini and Bianchi, who quickly influenced Guido to undertake research in geometry. He presented his doctoral thesis Cliffords Parallelism in Elliptic Spaces in 1900. Most young doctoral students take a few years to make themselves well know in their area. However, Guido was lucky for his teacher Bianchi was about to publish an important work on differential geometry. Bianchi discussed the results of Guidos thesis in his treatise, which appeared in 1902. Guido remained at Pisa to qualify as a university teacher. Most mathematicians at this stage in their careers extend the work they have begun in their doctoral thesis, but not Guido. He attacked a completely new topic to the one he had studied for his doctoral thesis studying the theory of harmonic functions in spaces of constant curvature. Guidos interests were exceptionally wide moving from his early work on differential geometry towards analysis. In this area he work on differential equations, analytic functions, and functions of several complex variables. He taught courses on these analysis topics at both the Politecnico and the University in Turin. During World War I, Guido studied the accuracy of artillery. These investigations led him on to work on acoustics and electricity. Guido was forced to retire from his chair in Turin. He had no wish to leave Italy but he had two sons who were engineers and, always a man who was devoted to his family, Guido decided that his sons had no future in a country whose official policy was anti-Semitism. When he received an invitation from the Institute for Advanced Study in Princeton in 1939, Guido  made the decision which he believed was best for his family. They moved to the United States immediately, although Guido himself was in rather poor health by this time. For some men, this stress may culminate or be expressed in a â€Å"midlife crisis. † This crisis has been variously described as a pervasive sense of alienation from ones own being in the world, unidentified or misunderstood feelings of anxiety or depression, and/or physical symptoms expressive of psychic distress. In an attempt to bring some order to conflicting reports about the experience of people entering middle age, we reviewed the existing literature. A lack of consensus soon became apparent. Some writers argued that a midlife crisis was a universal experience in male development; others suggested that men reached their peak of self-actualization at this point. Looking at the literature more closely, we saw that the research findings seemed to depend upon which methods were used and in which culture the middle-aged population was being studied. Psychoanalysts, psychiatrists, and other writers working with clinical data often see a middle-age crisis as universal a developmental inevitability. Levinson proposes, as did Jaques and others, a developmental sequence, with a period of midlife crisis, which â€Å"exists in all societies, throughout the human species, at the present stage of human evolution† (Sifford 1983). More recently, theorists like Slater, Laing, and Henry have focused on the alienating effects of socialization into a culture based on denial, distortion, and repression. Culture, that is, works to deny and distort what is most human in us. Regardless of whether we see midlife crisis as a consequence of social structure or culture, many theorists tell us that midlife crisis is widespread phenomenon. The impact of historical forces on the life course does not stop with one generation. Each generation encounters a set of historical circumstances that shape its subsequent life history and that generation transmits to the next one both the impact that historical events had on its life course and the resulting patterns of timing. Cultural norms governing the timeliness of life transitions (being â€Å"early,† â€Å"late,† or â€Å"on time†) and norms governing familial obligations also shape individual and collective family timing. In all these areas, historical and cultural differences are critical. Particularly significant is the convergence of socioeconomic and cultural forces. For example, â€Å"middle-age crisis† was a relatively recent invention in popular psychology in American society. It was attributed to middle-class women in particular in describing the problems connected to menopause and the â€Å"empty nest† in mid adulthood. â€Å"Middle-age crises† were not widespread, however. They were a product of stereotypes and a social construction rather than of sociobiological or familial realities. Since the 1970s, a considerable volume of feminist psychological literature has placed â€Å"middle-age crisis† in its proper perspective by exposing the cultural and â€Å"scientific† stereotypes that created the concept (Lawrence 1980). For the process to be fully working, then, we would expect to have evidence from lay accounts that the wider public had accepted and normalised the condition. Further evidence was provided by a Gallup poll survey in 1992 which found that over two-thirds of middle-aged men in the UK believed that there was some indefinable phenomenon called the ‘midlife crisis’. Furthermore, it stated that over half of the sample thought they had experienced a midlife crisis, or were actually having one, at some point between the ages of 40 and 60 (Neustatter 1996:80). Second, a further stage occurred in the United States when the midlife crisis started to appear as a legitimate condition in course material designed for the training of nurses. The psychologist Carl Jung believed that in Western cultures, the midlife crisis of males is rooted in a search for deeper spiritual roots (Marin 2001). From the perspective of male and female roles, there is often a reversal of roles away from the closed/traditional paradigm; that is, the husband moves inward to find strength for the future, and the female moves outward to the work world and career (Morris 1995). Thus midlife men experience the self-doubts, malaise, and concern over issues of a failure of adaptation. External economic changes in the opportunity structure affect changes in the timing of entry into the labour force, and, ultimately, retirement. Institutional and legislative changes, such as compulsory school attendance, child-labour laws, and mandatory retirement, shape the work-life transitions of different age groups and eventually influence their family life as well. People who suffer a midlife crisis in this form see the exciting experience of forward movement as ending with youth and the future as repetition and decay. Some people have midlife crises, but most do not. Crises do occur in midlife, but they are usually caused by a variety of factors, certainly not by chronology alone. Then, to assume that the landlord claim that my employees was damage the kitchen cabinets after one month they have stay in the rented apartment, so I am expect to write a report to Mr. Abu on what kind of legal solution that might can be taken by the landlord and how I am go to solve the situation and I need to justify my answer to avoid my legal liability on such damage to property in apartment. Apart from that, I need to describe the nature contractual liability arising from the damages that found in the house and whether tenants are partially or wholly liable for damages done to the premises. 2.0 The Main Element for Binding a Valid House Renting Contract 2.1 Offer An offer or proposal for the creation of an agreement is necessary. Section 2(a) Contract Act 1950 provides that if a person means another who is willing to do or omit to do something to the consent of the other as the act or abstinence could be obtained, it is said, on to make a suggestion. The first part of the Section 2(c) in the Contracts Act 1950 calls the person who make the proposal promisor. Under the contracts Act 1950 and English Law, an offer or proposal is something which is capable of being changed into the agreement by its acceptance. The proposal should be a definite promise to be bound provided certain specified terms that are accepted. The promisor or also called as the offeror must have stated his willingness to an obligation to undertake certain specific terms, leaving the option of its refusal or acceptance to the offeree, the person to whom that offer is made. Then contract is complete once the offeree is accept the offer. (GILLIES, P, 2004). Thus, offer is one of the parties made a promise to do or prevent from doing some specified action in the future. (Jec.unm.edu, 2015). Apart from that, the offeror may make the offer to a particular person or to the whole world. 2.2 Acceptance To form a binding valid house renting contract, the offer must have an acceptance. Acceptance of an offer is the offer was accept unambiguously. The acceptance must be an agreement to each of the terms of the offer. Section 2(b) of the contract Act 1950 provides that when a person made signifies his assent thereto to whom, the proposal is said to have been accepted. When a proposal was accepted, it will become a promise. Apart from that, the person that who is accepted the proposal is called promisee. In additional, acceptance must be communicated to the offeror. The communication of acceptance may be express or implied. (Gulshan, Kapoor and Paliwal, 2008). Furthermore, acceptance of any promise which is made in performance or words that could say to be express. In contrast, acceptance that made other than words and performance is say to be implies. For proposal to be changed in a promise, the acceptance of the proposal must be absolute and unqualified, so that the acceptance is complete consensus. Then, if the parties are still bargaining, agreement is still not yet formed and the proposer cannot prescribe silence as a manner of acceptance. 2.3 Intention to Create Legal Relations A statement to be an offer, it must be made with the intention that it be binding upon acceptance. It is also necessity that all the parties to an agreement have an intention to create legal relations which is meaning the parties intend the legal consequences attach to their agreement. (JONES, L, 2013). In short, the parties intend that the agreement will be binding with recourse to some external judge for this enforceability. In determining whether the parties intend their agreement to be legally binding, the courts are guided by two presumptions such as parties to a domestic or social agreement do not intend to be legally bound and parties to business agreement intend to be legally bound. These are presumptions only and can be rebutted by sufficient evidence to the contrary. 2.4 Consideration Considerations is something of legal value that each party gives to the contract to bind the agreement. (Goldman and Sigismond, 2014). So, the consideration is especially important where the agreement involves a promise to the act in a particular way in future. In exchanges where there is an immediate, simultaneous transfer of, for example, good for money, the doctrine of consideration applies in theory but rarely will causes practical problems. An agreement without consideration can consider is void. Apart from that, consideration need not be adequate and not be too vague. The words consideration defined as when, at the desire of the promisor, the promisee or any other person has done or refused from doing, or does or refused from doing, or promises to do and refused from doing something, such act or abstinence or consider as promise is called a consideration for the promise. 2.5 Certainty Certainty is the terms of a contract are certain when each of the provision is described or explained properly and clearly set forth. (Definitions.uslegal.com, 2015). The terms of an agreement cannot be vague but must be certain. An agreement which is not capable of being made certain or uncertain is consider as void. An enforceable contract requires certainty of terms. Which means for an agreement to be a contract, it must be apparent what is the terms of the contract are. If the important term in the agreement is not settled, the agreement is not a contract. 2.6 Capacity Capacity to contract is legal and mental ability to understand the nature of an enforceable agreement. (Goldman and Sigismond, 2011). Furthermore, capacity is mean that the legal competence of a person to enter into a valid contract. The parties entering into a contract should be also competent to contract, that is to said, they must have the legal capacity to do so. Capacity refers to the ability of the parties to a contract to fully understand its terms and obligations. For example, a contract made with person mentally unsound, a bankrupt person and person under age 18 in Malaysia is void. Every person is competent to a contract if who is of the age of majority which is eighteen years old to the law to which he is subject, and who is healthy and not disqualified from contract by a law which it is subject there. However, there are some exceptions to this rule which are Contracts for necessaries, Contracts of scholarship and Contracts of insurance as well. 3.0 The Damaged level of kitchen by Alex Recording Sdn Bhd employee Alex Recording Sdn Bhd employees have damaged a part of the premise which is kitchen’s cabinet. The damaged cabinet has been left for a long period without any maintenance or repair. 3.1 Legal action take by landlord Due to Alex Recording employee Sdn Bhd employees had damaged the kitchen’s cabinet and left for a long period without any maintenance or repair. However, Alex Recording Sdn Bhd employees still used the cabinet but without repair it. That mean that the cabinet is not broken by Alex Recording Sdn Bhd employees and it should by someone else who had rented the premises before. Basically, Alex Recording Sdn Bhd is not liable to pay the repair fee to the landlord due to the cabinet is not broke by their employees and also the Rental Agreement didn’t notice or mention that the RESIDENT should check all the items is on the good condition before move in the premises. 3.4 Element of the contract between Alex Recording Sdn Bhd and landlord Offer Is a proper offer. Acceptance Is a proper acceptance. Consideration The agreement have consideration. Certainly The agreement is certain. Capacity Both parties have legal capacity. Hereby, there are several elements of contract which has existed in this case. The elements are offer, certainty, consideration, capacity, intention to create legal intention as well as acceptance. 4.1 Offer There’s a valid offer which offered by Alex Recording, which proved by the signature of Director of Alex Recording. Moreover, terms and condition has written down in the contract by offering the landlord to have the signature. 4.2 Acceptance The acceptance in this situation is valid. We assume that the landlord has read the terms and condition only the landlord sign the contract. Meaning to say that the landlord has agreed to the contract before the landlord sign and accept this offer by Alex Recording. 4.3 Consideration There’s consideration in this contract which state in the first terms and condition in the contract, that the Alex Recording will pay RM1300 in advance for the first month as well as the security deposit of RM300, in total is RM2050 are to be paid to the landlord, Lim Wei Shang. 4.4 Certainty This contract is definitely certainty and there’s no vague terms and condition written, and labeled neatly. 4.5 Capacity The offeror and offeree has been officially 18 and above. Apart from that, both of the parties are not mentally unsound. Furthermore, they’re not in bankrupt. Thus, this is a valid contract. 4.6 Intention to create legal relation In this case, there’s an intention to create legal relation which is business relation between landlord and director. Our party will only agree to take the responsibility of partially liable since the cabinet in the kitchen is already not in a good and well condition before we starting the agreement contract and entered into rented the room. We will only take half of the responsibility as we are only partially liable for the damage of kitchen cabinet. The cabinet is too old can be see it was use many year and it is the landlords responsibility in change of a brand-new or a well-fixed cabinet before renting the room out. The landlord should also be partially liable for the damage as the landlord should take care of the safety of the customer. The landlord had already broken a condition called contributory negligence. As such, we will only be partially liable of the damage as we should not be the only party that should be responsible for the damage. From the east there loomed Stalin’s Soviet Union with its communism government and Totalitarian ruling mindset. Many were oblivious to the facts surrounding communism and looked hopefully to it. The reason for this was as Mitzi Brunsdale states because of â€Å"all kinds of personal and social inadequacies† (139). Many in the west were discouraged with present conditions and looked to Stalinism for hope. Many of the â€Å"Western supp ort for Stalin often took the form of neo-religious adulation† (Brunsdale139). On the other hand, George Orwell stood in direct opposition. A white boat dubbed the â€Å"Naughty Nymph,† was our vehicle for the day to take us on endless adventures. Dad was getting the food on the boat as Tawnya and I ran around looking for secret hiding spots and the better place to put our towels. The bow of the boat seemed to be the best spot so that is where we settled. Dad yelled if we were ready to take off, and off we went. The waters were crystal blue. The coral on the sea floor was popping out at me as the water worked as magnifying glass. There were islands all around us, chess pieces of the sea, which shot out of the ocean without warning. The transcontinental railroad was of tremendous importance to the development of the Union because it opened the western frontier to increased settlement and represented the growing integration of the country. It stimulated trade between east and west, and transformed the dormant frontier into an essential component of the Union. A very different situation existed before the completion of the transcontinental railroad. The western region of the United States was almost completely separated from the east. Travel between the two regions was agonizingly long and difficult, and transportation of goods was costly and inefficient. There were three main routes that could be taken to travel from the east to the west. The first was an expensive four-month sea voyage around the tip of Cape Horn. The second route was the particularly challenging horseback journey through the malaria-infested swamps of the Isthmus of Panama. The final option was to travel across the US mainland by wagon, which a strenuous and lengthy expedition. The settlement of the Oregon boundary dispute, the acquisition of Mexican territory, the discovery of gold in California, and the spirit of manifest destiny were various motives that inspired people to undergo the journey across America. Many people soon believed that a transcontinental railroad would be enormously beneficial to the country. The bitter feelings between the North and South resulting from divergent economies, life styles, and opinions on the divisive issue of slavery needed to be resolved before attention could be concentrated on the transcontinental railroad. By 1860, the North and South had developed two very different economies. The primarily agricultural South relied on its chief crop, cotton, which accounted for a good deal of US exports. To produce cotton in such large amounts, the South depended on the plantation system, and thus on slavery. The North however, was an industrial giant and had no desire for slave labor.
